Andy Simmons, P.C. Experienced litigator and general counsel for your small business.People used to call what I do “general counsel” but these days that term is often used by lawyers who never go to court, and that’s not me.

I go to court a lot, so I prefer to call myself a “business lawyer” who has a wide range of both litigation and transactional experience.

My litigation experience over the years ranges from breach of contract, products liability, personal injury, trademark litigation, securities fraud, consumer protection, real estate and employment law.  I have also worked in all of these areas of law on the transactional side, such as drafting contracts, setting up companies, obtaining trademark registrations, drafting employee handbooks and reviewing leases.

That’s what qualifies me to be “general counsel” for my clients.

What I do is I stand by my clients, from start to finish, from office, to court, and back.

When I work on business transactions, my goal is to help keep my clients out of court, but if that can’t be avoided, my experience as a litigator informs my transactional work. When I review or draft a contract or other legal document for a client, I am thinking of how it will play out as “Exhibit A” in a court case. Will it hold up?  What will a judge or jury think of it? To answer those questions, I draw on not only my knowledge of case law and statutes, but also upon my own experience in the courtroom.  It’s in the court room where you see first hand what works and what doesn’t.
